Why there is no federal route

The First Amendment limits the government, not private employers, so a private-sector worker generally has no federal claim for being disciplined over political speech or lawful off-duty political activity. The New York route: DHR

It shall be unlawful for any employer or employment agency to refuse to hire, employ or license, or to discharge from employment or otherwise discriminate against an individual in compensation, promotion or terms, conditions or privileges of employment because of: (a) an individual's political activities outside of working hours, off of the employer's premises and without use of the employer's equipment or other property, if such activities are legal. Political activities are defined as: (i) running for public office, (ii) campaigning for a candidate for public office, or (iii) participating in fund-raising activities for the benefit of a candidate, political party or political advocacy group.

New York Labor Law § 201-d prohibits adverse action for off-duty political activities — defined as running for office, campaigning, and fundraising for candidates, parties, or advocacy groups. File with DHR or civil action within 3 years.
